it is politics. these are not legitimate claims by and large, but the administration has made it known if you come to our border, or falsely claim asylum, you are in effect an american citizen. often times, they get more than u.s. citizens. you get a court date, for five years down the road, it is so laughable. this administration has no intention of changing because the issue doesn't end at the border. that is a manifestation of this immigration problem which you see in new york. eric adams brought it to the attention unwittingly. this is an expensive problem. there is lots of cost and you hit on those with the health care costs and those

don't go away once people are here. these burdens remain on the american citizen and there doesn't seem to be anything that is driving this administration to change. they talk about comprehensive immigration reform is needed, amnesty plus the euphemism. they are not changing. >> you get a court date and you abscond, you don't, and eventually they find you and you have your hearing. is there any consequence for not honoring your court date, for blowing it off until they come find you? is there a presumption that make it a negative consequence of not showing up? >> it is better than that. if they don't show up, the administration has made it clear they will not go look for them. if you don't show up, you are almost assured they will not

find you unless you are convicted of a serious crime and then it doesn't matter. when they get there asylum claim, even if they are ordered deported, they are not whisked out the door. they have appeal processes and they will be ordered to self deport. the consequences are minor, if any. they don't want people to come to court. they want them to stay. they don't support anyone. we are bringing in three or 4 million people a year, most of them illegitimately. how do you get all of these people out of here and the short and long answer is they are not going to try. >> you just described it as a crisis. thank you for joining us.

the pending is going to have to prove to the journey that he was in fear of his life or the life of others. they have to show a reasonable person would have used this level of force. the choke hold is unlawful in most jurisdiction but this is not a trained police officer. it was someone responding to a scene he believed was turning violent. this will have to go in front of that jury. it is not clear what the jury will know, of the long rap sheet here involving mr. neely.

some of the past defenses dealt with violent acts. the defense has its own tough choice to make. this is a strong defense case because people have said, i felt endangered before neely was taken down. you have the defendant saying that. if those witnesses take the stand and support that view, it is going to be a strong case. the question is is the defense going to be satisfied with a strong case for a hung jury or do they want to go for the full acquittal? they might have to put penny on the stand. he showed great poise in this interview. he may be up to that challenge.

>> would you put penny in the grand jury? i think he has the right to go to the grand jury and ask them not to indict. would you put him in the grand jury if you were his lawyer, or think about it? >> i would think about it. i don't follow the view that you put your client on the stand whether it is a grand jury or a trial. i don't always agree with that. when i saw an interview with penny, if he were my client, i would give it serious consideration. it is someone obviously able to handle those circumstances when you are speaking to somebody about a traumatic event. it is an obvious tragedy for everyone involved.
